Terms of Service
Last updated 2026-09-17
This is a plain-language summary written for launch. Have a lawyer review it before you rely on it.
What this is
whatsapi.sh ("whatsapi", "we") sends WhatsApp messages through WhatsApp accounts that you pair with us. It is UNOFFICIAL. We are not part of WhatsApp or Meta, and the service works the way WhatsApp Web works: as a linked device. These terms cover your use of the site, the dashboard and the API. The service is run by OpenWings Automação Comercial Ltda. (CNPJ 63.852.648/0001-06), Rua Padre João Wislinski, 441, Santa Cândida, Curitiba – PR, CEP 82630-494, Brazil.
The risk you accept
WhatsApp can restrict or permanently ban any number that uses unofficial automation. It can happen at any time, with no notice, and nobody can appeal it, us included. You confirm that the numbers you pair are yours to use, and that you accept this risk. We show you this warning before you pair a number, and our limits exist partly to lower the odds. They cannot remove them.
Your account and keys
You are responsible for everything done with your API keys. Keep them secret, replace them if they leak, and revoke them from the dashboard. We store only a hash of each key, so if you lose the plaintext, the fix is a new key. We may suspend or close accounts that abuse the service, break these terms, or put our infrastructure at risk.
Acceptable use
You may not use whatsapi to send spam, unsolicited bulk messages, illegal content, malware, or anything that breaks the law where the sender or the recipient lives. Messages should go to people who expect them. We watch for abuse and may suspend accounts that blast strangers, with no refund of unused quota.
Billing
You pay for messages sent, metered monthly by your plan, and your plan sets how many numbers you can connect. Message packs never expire and are used only after your monthly quota runs out. Prices are listed in BRL, USD and EUR, and your first purchase sets the currency your account pays in. Subscriptions renew every month until you cancel them in the billing portal, and cancelling takes effect at the end of the period you already paid for. Refunds are at our discretion, except where the law says otherwise.
No guarantees
The service is provided as is. It depends on an unofficial channel, so we cannot guarantee uptime, delivery, speed, or that WhatsApp will not change or block what the service relies on. To the maximum extent the law allows, our liability for any claim is limited to what you paid us in the twelve months before the claim.
Data
We process the data described in the Privacy Policy: your account details, your API keys (stored as hashes), metering records, delivery logs and the chat history your numbers keep. We do not sell personal data.
Changes and contact
We may update these terms, and we will announce material changes in the dashboard. If you keep using the service after a change takes effect, you accept it. Questions: gustavo@openwings.com.br.
